How to determine whether you have an “AB” or “ABC Living Trust:

If your Living Trust was drafted by this office, please examine Article Six and Article Seven of your Living Trust. 

• If you see a section titled “BYPASS TRUST”, you probably have an “AB” Trust.

• If you see a section titled “QTIP TRUST” or “QUALIFIED TERMINABLE INTEREST PROPERTY TRUST”, you probably have an “ABC” Trust.

If your Living Trust was not drafted by this office, please examine your entire trust.  If you see reference to any of the following terms, your probably have an “AB” Living Trust:

• Bypass Trust

• Exemption Trust

• Credit Shelter Trust

• Non-Marital Trust

• “B” Trust

• Marital Share

• Non-Marital Share
